Terms and Conditions

1. Definitions

For the purposes of this Agreement, the following terms shall have the meanings ascribed to them:

• “Application” / “App”: The Palmaestro mobile software application available on the Apple App Store and Google Play Store, including all its features, AI modules, content, and updates.
• “AI Readings”: Automated, algorithmically generated interpretations of palm images, birth data, and astrological parameters produced by the Application’s machine-learning models, processed via Google Cloud Platform and/or contracted external AI APIs.
• “Biometric Data”: Digital photographs of the user’s palm, hand, or fingers captured via the device camera for purposes of palmistry line analysis and character assessment.
• “Google Cloud Processing”: The use of Google Cloud Platform infrastructure and/or third-party AI APIs contracted by the Company to perform server-side palm image analysis when selected by the user.
• “In-App Purchase” / “IAP”: Any digital goods, premium subscriptions, or paid features purchased through Apple App Store or Google Play Store billing infrastructure.
• “Services”: All features, tools, functionalities, and content provided through the Application including palmistry readings, horoscopes, biorhythm analysis, numerology, and character reports.
• “Subscription”: A recurring paid plan (weekly, monthly, or annual) granting access to Premium features of the Application.
• “User Content”: Any data, images, or information voluntarily submitted by a User, including palm images, name, date/time/place of birth, and preferences.

2. Acceptance of Terms

2.1 By downloading, installing, accessing, or using the Application, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy (incorporated herein by reference). If you do not agree, do not install or use the Application.

2.2 These Terms apply to all visitors, registered users, and others who access or use the Application. If you are using the Application on behalf of a business entity, you represent that you have authority to bind that entity to these Terms.

2.3 We reserve the right to update these Terms at any time. Material changes will be notified via in-app notification or email at least 30 (thirty) days before taking effect. Continued use of the Application after any changes constitutes your acceptance of the new Terms.

3. Eligibility and Age Restrictions

3.1 The Application is intended strictly for users aged 18 (eighteen) years or older. By using the Application, you represent and warrant that you are at least 18 years old and possess the legal capacity to enter into a binding contract under applicable Indian law.

3.2 We do not knowingly collect personal data from individuals under 18 years of age. If we discover a user is under 18, we reserve the right to immediately terminate the account and delete all associated data. No biometric data (palm images) shall be collected from users under 18 under any circumstance.

3.3 If you are a parent or guardian and believe a minor has registered, please contact us immediately at Admin@palmaestro.com.

4. Description of Services

4.1 The Application provides the following AI-driven services. Palm image analysis is always performed via Google Cloud Platform (GCP) and/or contracted external AI APIs — there is no on-device AI processing. The device camera captures the image, which is transmitted to GCP for analysis, and only the textual reading result is returned to your device:

• AI Palm Reading: Real-time biometric scanning of palm lines (life line, head line, heart line, fate line, and minor lines), followed by AI-generated interpretations of personality traits, life patterns, and character assessments.
• Daily, Weekly & Monthly Horoscopes: Personalized astrological forecasts based on birth details and Sun/Moon sign.
• Biorhythm Analysis: Calculation and visualization of physical, emotional, and intellectual biorhythm cycles.
• Numerology Reports: Name and birth-date numerology readings including life path number, destiny number, and soul urge number.
• Compatibility Analysis: Relationship compatibility assessments using astrological synastry and palmistry principles.
• Premium Reports: Detailed AI-generated life reports available via In-App Purchase or Subscription.

4.2 Freemium Model. Basic features (limited daily horoscope, single free palm scan per day) are available at no charge. Premium features (unlimited scans, full reports, compatibility analysis, ad-free experience) require a paid Subscription or one-time In-App Purchase.

4.3 Technology Disclosure. Palm image analysis is always performed using Google Cloud Vision API and/or contracted third-party AI APIs. There is no on-device AI model. By using the palm scanning feature, you consent to your palm images being transmitted to GCP and these services in accordance with the Privacy Policy. Your only choice is whether to save the resulting reading.

4.4 Service Modifications. We reserve the right to modify, suspend, or discontinue any feature at any time, with or without notice. We shall not be liable for any modification, suspension, or discontinuation of Services.

5. Entertainment Purposes Only — Disclaimer of Accuracy

5.1 No Guarantee of Accuracy. The Company does not warrant, guarantee, or represent that any AI Reading, prediction, horoscope, or assessment is accurate, complete, reliable, or error-free. Results are generated by machine learning models trained on traditional palmistry folklore, astrological interpretations, and pattern recognition algorithms and are inherently subjective and probabilistic in nature.

5.2 Subjective Interpretation. Palmistry and astrology are traditional belief systems and cultural art forms. Results reflect one possible interpretation of symbolic and traditional principles and shall not be construed as objective fact, scientific diagnosis, or empirical prediction of future events.

5.3 No Reliance for Decisions. You must not rely on any content generated by the Application for major life decisions, including medical, financial, legal, career, relationship, or safety decisions. The Company expressly disclaims all liability for decisions made in reliance upon AI-generated content.

6. Non-Professional Advice Disclaimer

6.1 Not a Medical Tool. The Application is not a medical device, diagnostic tool, or healthcare service. Nothing in the Application constitutes medical advice, diagnosis, prognosis, or treatment. Consult a qualified medical professional for all health concerns.

6.2 Not a Mental Health Service. The Application does not provide mental health counselling, psychiatric advice, or psychological therapy. If you are experiencing a mental health crisis, please contact a licensed mental health professional or call a crisis helpline immediately.

6.3 Not Legal or Financial Advice. Insights regarding wealth, career, business, or investments are speculative, entertainment-based interpretations. Consult qualified legal and financial professionals for such matters.

6.4 Not a Relationship Counselling Service. Compatibility analyses are for entertainment only and must not be relied upon for decisions about personal relationships, marriage, separation, or family matters.

6.5 Emotional and Mental State Disclosure. For the best use of the Application’s readings, you are advised to use the service when in a calm state of mind. The Company is not responsible for any emotional response to, or decision made as a result of, AI-generated content. If you feel the Application’s content is adversely affecting your mental well-being, please discontinue use immediately.

7. User Account and Registration

7.1 Account Creation. To access full features, you must register by providing your name, a valid email address, and a secure password. You may also sign in via Apple Sign-In or Google Sign-In (OAuth 2.0). You agree to provide accurate, current, and complete information and to keep it updated.

7.2 Account Credentials. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. The Company will not be held responsible for any loss arising from unauthorized use of your account.

7.3 One Account Per User. You may create only one account per individual. Creating multiple accounts to circumvent restrictions, bans, or to access free trials multiple times is a material breach of these Terms and will result in permanent account termination.

7.4 Company Access to Account. In order to ensure high quality services, respond to complaints, and comply with applicable law, you consent to authorized Company personnel accessing your account and records on a case-by-case basis to investigate complaints, allegations of abuse, or suspected policy violations.

7.5 In-App Account Deletion. You may delete your account at any time via Settings > Account > Delete Account within the Application. Upon deletion, your personal data and biometric data will be removed in accordance with our Privacy Policy.

8. User Obligations and Prohibited Conduct

8.1 You agree to use the Application only for lawful purposes and in accordance with these Terms. You represent that you are an individual (not a corporation or other business entity) using the Application for personal, non-commercial purposes. You expressly agree NOT to:

• Use the Application for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation.
• Upload palm images of any person other than yourself without their explicit, informed, and documented consent.
• Attempt to reverse engineer, decompile, disassemble, copy, modify, or derive source code from the Application or its AI models.
• Use automated scripts, bots, scrapers, crawlers, or data mining tools to access the Application or its content.
• Use the Application or any content derived from it for the purpose of training, fine-tuning, benchmarking, or developing any artificial intelligence model, machine learning algorithm, or large language model. This prohibition covers any form of data extraction, scraping, copying, or downloading, whether automated or manual, and applies regardless of the intended use. Violation may result in legal action including injunctive relief and monetary damages.
• Interfere with or disrupt the integrity or performance of the Application, its servers, or connected networks.
• Attempt to gain unauthorized access to any portion of the Application, other user accounts, or the Company’s computer systems.
• Upload, transmit, or share any content that is obscene, defamatory, harassing, fraudulent, or that violates any third-party right.
• Resell, sublicense, or make any commercial use of the Application or the Services without the express prior written consent of the Company.
• Share, distribute, or publish any AI-generated content from the Application for commercial purposes without prior written consent.

9. Camera Permission, Biometric Data, and Google Cloud Processing

9.1 Camera Permission. To use the palm-scanning feature, you must grant the Application access to your device’s camera. You may revoke this permission at any time via your device’s OS settings, which will disable the real-time scanning feature.

9.2 Nature of Biometric Data. Palm images captured by the Application are processed for character analysis using AI-based palmistry line detection algorithms. These images are not fingerprints, voiceprints, retinal scans, or any biometric identifier used for law enforcement, forensic identification, or identity verification.

9.3 How Palm Image Processing Works.

• Image Capture: Your device camera captures the palm image locally on your device. The image is then immediately transmitted via SSL/TLS 1.3 encrypted connection to Google Cloud Platform for AI analysis. There is no on-device AI model — GCP always performs the analysis.
• Reading Storage (Your Choice): After GCP generates your reading, the palm image is immediately deleted from GCP servers unless you explicitly choose to use the “Save Reading” feature. If you save a reading, the palm image is retained on GCP’s encrypted servers for the period you specify. You may delete any saved reading at any time via Settings > My Readings > Delete. You will receive a disclosure prompt before saving for the first time.

9.4 License to Process. By using the palm-scanning feature, you grant the Company a limited, non-exclusive, non-transferable, royalty-free licence to process your palm images solely for the purpose of generating your AI Reading. This licence terminates when you delete your scan or close your account.

9.5 Third-Party AI APIs. Palm images processed via GCP may also be analysed by the Company’s contracted third-party AI processing APIs. These partners are contractually prohibited from using your images to train their models, and all data sharing is governed by binding data processing agreements.

10. In-App Purchases, Subscriptions, and Refund Policy

10.1 Billing Infrastructure. All In-App Purchases and Subscriptions are billed exclusively through the Apple App Store or Google Play Store billing systems. All transactions are processed by Apple or Google under their respective billing terms. The Company does not directly process, store, or have access to your payment card information. You agree that any and all billing matters shall be governed by the Apple App Store or Google Play Store terms applicable to your account.

10.2 Apple EULA Disclosure. If you download the Application via the Apple App Store, you acknowledge that this agreement is between you and the Company only, and not with Apple Inc. Apple is not responsible for the Application or its content. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application.

10.3 Subscription Plans. The Application offers the following tiers:

10.4 Free Trials. Where offered, a free trial automatically converts to a paid subscription at the end of the trial period unless cancelled at least 24 hours before expiry. Each eligible user is entitled to one free trial per subscription type. Any unused portion of a free trial is forfeited upon upgrade to a paid plan.

10.5 Auto-Renewal. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your Apple ID or Google Play account will be charged for renewal within 24 hours before the end of the current period. No cancellation of a current subscription is permitted during the active subscription period; the cancellation takes effect at the next renewal date.

10.6 Cancellation Instructions.

• Apple App Store: Settings > [Your Name] > Subscriptions > Palmaestro > Cancel Subscription.
• Google Play Store: Play Store > Profile Icon > Payments & Subscriptions > Subscriptions > Palmaestro > Cancel Subscription.

10.7 Refund Policy. Refunds are governed as follows:

• (a) Digital Content Consumed: Once a personalized AI palm reading report is generated, a specific premium query is answered, or any premium subscription feature is accessed, the digital service is considered “fully delivered and consumed” and NO REFUND will be issued.
• (b) Refund Window: If no premium feature has been consumed, a refund request must be submitted to Admin@palmaestro.com within 48 (forty-eight) hours of payment. Requests submitted after 48 hours may not be entertained.
• (c) Technical Errors: If a subscription charge is deducted due to a technical error and no service was delivered, you must notify the Company within 24 hours of such deduction. The Company will investigate and process eligible refunds within 7 business days after verification.
• (d) Apple/Google Refunds: For App Store refunds: reportaproblem.apple.com. For Google Play refunds: play.google.com/store/account/subscriptions. All refunds processed will be made after deducting applicable transaction charges levied by the respective payment platform.

11. Account Suspension, Blocking, and Termination

11.1 Right to Block or Restrict Access. The Company shall have the absolute, unconditional, and unrestricted right, at its sole and exclusive discretion, to block, restrict, suspend, or otherwise limit any User’s access to the Application and/or its Services, without any requirement of prior notice, explanation, or justification. Such action may be taken at any time and for any reason the Company deems appropriate, including but not limited to breach of these Terms, fraudulent activity, misuse of the refund system, or conduct that is detrimental to other users or the platform.

11.2 No Liability for Suspension. Under no circumstances shall the Company be held liable for any loss, inconvenience, damage, cost, claim, or consequence whatsoever arising out of or in connection with any blocking, restriction, suspension, or denial of access. The User expressly waives any right to dispute, contest, or seek compensation for such actions.

11.3 Permanent Deactivation. In the event of repeated violations, misconduct, or any breach of the Platform’s policies, the Company may, at its sole and final discretion, permanently deactivate the User’s account. Upon such deactivation, the User shall be irrevocably barred from accessing or using the Platform or any of its services in the future.

11.4 Termination by You. You may terminate your account at any time by deleting the Application and initiating account deletion via Settings > Account > Delete Account. All data will be deleted per the Privacy Policy. Active subscription charges are not refunded upon voluntary account deletion.

11.5 Surviving Clauses. Sections 5, 6, 8 (AI training prohibition), 11, 12, 14, 15, 16, and 17 shall survive termination.

12. Intellectual Property Rights

12.1 Ownership. The Application, including but not limited to its software code, AI models, algorithms, design, UI/UX, graphics, text, logos, trademarks, and all content generated by the Application (“Company IP”), is the exclusive property of Palmaestro and is protected by copyright, trademark, patent, and other applicable intellectual property laws of India and international conventions.

12.2 Limited User Licence. Subject to compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable, personal licence to download and use the Application on devices you own or control, solely for your personal, non-commercial use.

12.3 Restrictions. You may not: (a) copy, modify, or distribute the Application or any Company IP; (b) use the Application’s name, logo, or brand in any manner without prior written consent; (c) create derivative works from the Application or its content; or (d) use any trade names, images, logos, or trademarks of the Company for any commercial purpose without express written permission.

12.4 User Content Licence. By submitting User Content (including palm images), you grant the Company a limited licence to process such content solely for service delivery as described in Section 9. You retain ownership of your User Content.

13. Privacy and Data Protection

13.1 Privacy Policy. Your use of the Application is governed by our Privacy Policy, incorporated herein by reference. Our Privacy Policy is fully compliant with the Digital Personal Data Protection (DPDP) Act, 2023, the IT (Reasonable Security Practices) Rules, 2011, and applicable Apple App Store and Google Play Store data policies.

13.2 Google Cloud & External APIs. By using the palm-scanning feature, you consent to your palm images being transmitted to and processed by Google Cloud Platform and/or contracted external AI APIs, as detailed in the Privacy Policy. This transmission always occurs as there is no on-device AI model. All processors are contractually bound by data processing agreements.

13.3 Communication Consent. By registering an account, you authorize the Company to contact you via email, phone, or SMS for service-related communications, including account updates, subscription notices, and grievance responses. You may opt out of marketing communications at any time.

14. Disclaimers and Limitation of Liability

14.1 “As Is” Basis. The Application and all Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14.2 Limitation of Liability. To the fullest extent permitted by applicable law, the Company, its directors, officers, employees, agents, licensors, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or related to: (a) your use of or inability to use the Application; (b) any AI-generated reading, prediction, or insight; (c) any decision made in reliance on Application content; or (d) unauthorized access to your data. Our total liability shall not exceed the amount paid by you to us in the preceding 3 (three) months.

14.3 Indemnification. You agree to defend, indemnify, and hold harmless the Company and its affiliates, officers, directors, employees, consultants, and agents from and against any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Application; (b) your violation of these Terms; (c) your violation of any third-party right; or (d) any claim that your User Content caused damage to a third party.

15. Third-Party Services and Links

15.1 The Application integrates with the following categories of third-party services: (a) Apple App Store and Google Play Store (billing, distribution, authentication); (b) Google Cloud Platform and contracted AI/ML processing APIs (for cloud palm scan analysis); (c) Analytics providers (crash reporting and app performance monitoring); (d) Advertising networks for free-tier users (subject to user consent).

15.2 The Company is not responsible for the practices, content, or privacy policies of third-party services. Your use of third-party services is governed by their respective terms and conditions. The inclusion of any third-party link or service does not imply endorsement by the Company.

16. Governing Law, Jurisdiction, and Dispute Resolution

16.1 Governing Law. These Terms shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.

16.2 Jurisdiction. Subject to the arbitration clause below, any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Ludhiana, Punjab, India.

16.3 Arbitration. Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be conducted by a single arbitrator, in English, seated in Ludhiana, Punjab, India. The arbitral award shall be final and binding. Either party may seek interim or preliminary relief from the courts in Ludhiana, Punjab to protect their rights pending arbitration.

16.4 Consumer Rights. Nothing in this Section restricts your right to approach the appropriate consumer court or forum under the Consumer Protection Act, 2019, or the Data Protection Board of India under the DPDP Act, 2023.

16.5 Notice to Parties. All notices under these Terms shall be in writing. Notices to the Company shall be sent to Admin@palmaestro.com or to the registered address in Ludhiana, Punjab. Notice by email is deemed received 24 hours after sending; notice by post is deemed received 3 days after dispatch.

17. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020, the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Digital Personal Data Protection Act, 2023, the following Grievance Officer has been designated:

18. Miscellaneous

18.1 Entire Agreement. These Terms, together with the Privacy Policy and any additional feature-specific terms, constitute the entire agreement between you and the Company regarding the Application and supersede all prior agreements, oral or written.

18.2 Severability. If any provision of these Terms is held invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

18.3 Waiver. The failure of the Company to enforce any right or provision shall not constitute a waiver of that right or provision.

18.4 Assignment. You may not assign or transfer your rights or obligations. The Company may freely assign its rights and obligations in connection with a merger, acquisition, or sale of assets.

18.5 Force Majeure. The Company shall not be liable for any delay or failure to perform resulting from causes beyond its reasonable control, including natural disasters, acts of government, internet outages, or pandemics.

18.6 Language. These Terms are provided in English. Translations may be provided for convenience, but the English version shall prevail in case of any inconsistency.

18.7 Regional Language Access. In compliance with the DPDP Act, 2023, this document is available in any of the 22 languages listed in the Eighth Schedule of the Constitution of India upon written request to Admin@palmaestro.com.
